Agreement to These Terms
These Terms of Service apply to services provided by WebSolutionForge unless different terms are expressly agreed in writing for a specific project.
By approving a quotation, making the required advance payment, instructing WebSolutionForge to begin work or otherwise purchasing our services, the client confirms acceptance of the agreed project scope and these Terms.
Where a person engages WebSolutionForge on behalf of a business or organization, that person confirms that they have authority to approve the project and its related terms.
Services, Initial Enquiry & Project Requirements
WebSolutionForge provides website design, WordPress and Elementor development, website redesign, WooCommerce and eCommerce development, Shopify and Wix services, custom website functionality, optimization, maintenance, responsive development, basic on-page SEO and other agreed digital services.
Initial Contact
Clients are not expected to provide every technical or design requirement during their first enquiry. Initial contact is intended to give WebSolutionForge a general understanding of the business, the type of website required and the client's primary goals.
After the initial discussion, WebSolutionForge may provide a project requirement form or request additional information before confirming the final scope, quotation and estimated project timeline.
Website Type
Before the project scope is finalized, the client should clearly identify the type of website required and any important functionality that may affect development.
WooCommerce & eCommerce Requirements
For online stores, clients should communicate important requirements before development whenever reasonably possible.
- Approximate number of products
- Categories and subcategories
- Simple or variable products
- Sizes, colors and product variations
- Product filters and search
- Payment gateways
- Shipping methods and regions
- Tax requirements
- Coupons and discounts
- Customer accounts
- Wishlist or comparison features
- Product import or migration
- Custom checkout requirements
- Subscription or booking functionality
Portfolio, Business & Service Websites
Clients should communicate expected pages, portfolio categories, service categories, galleries, contact forms, filters, blog categories, case studies, testimonials, dynamic content and other important functionality.
Advanced category structures, custom filters, memberships, directories, booking systems, multilingual functionality and other specialized features can affect both project price and timeline.
Project Scope & Additional Work
The approved quotation, proposal, invoice, project brief or written agreement defines the services and deliverables included within the project price.
WebSolutionForge may recommend appropriate page structures, category systems, functionality, plugins or technical solutions based on normal web design and usability practices. A recommendation does not automatically mean that additional work is included within the original price.
New pages, extensive redesigns, additional features, custom integrations, advanced filtering, complex category structures or substantial requirements that were not included in the original agreement may require additional payment and a revised delivery timeline.
A major change in project type — for example, converting an agreed business website into a WooCommerce store after development has begun — will normally be considered a change of scope.
Payment Terms
Unless a different arrangement is expressly agreed in writing, WebSolutionForge uses a 50/50 project payment structure.
The initial 50% payment confirms the project, reserves development time and authorizes WebSolutionForge to begin work.
Once the agreed work has been substantially completed and the client has been notified that the website is ready for final review or delivery, the remaining 50% balance becomes due within the stated payment period, normally between one and three calendar days.
Reasonable final revisions that remain within the approved scope may continue during this stage. Revision requests do not create an unlimited extension of the final payment deadline.
Domains, Hosting, Licenses & Third-Party Costs
Unless specifically stated otherwise, the WebSolutionForge project fee covers our design and development services and does not include third-party purchases.
Domain names, hosting plans, premium themes, premium plugins, paid APIs, stock assets, software subscriptions, fonts, licenses and similar third-party costs are the client's responsibility.
If the client asks WebSolutionForge to purchase any third-party product or service on their behalf, the full purchase amount must be provided before WebSolutionForge makes that purchase.
WebSolutionForge can help select, purchase and configure hosting, domains and premium tools, but their purchase costs are separate from the website development fee unless expressly included.
Client Information, Branding & Website Content
After the scope has been agreed and the initial payment has been received, WebSolutionForge may request the project materials required to begin or complete development.
- Business or brand name
- Logo files
- Brand colors and guidelines
- Website text
- Service information
- Product information
- Contact details
- Images and media
- Social media links
- Existing website access
The client is expected to provide the core business information, logo and essential written content required for the website.
WebSolutionForge may use temporary placeholder text or sample media while developing a layout. Placeholder content is not intended to replace final client-approved content unless content creation has specifically been included in the project.
If essential information, branding or product details have not been supplied, WebSolutionForge may pause the affected part of development until the necessary materials are received.
Revisions & Client Satisfaction
WebSolutionForge aims to provide a reasonable revision process so the final website reflects the approved project requirements and design direction.
Unless a different arrangement has been agreed, a project includes up to eight structured revision rounds for work that remains within the original approved project scope.
Small corrections such as minor text changes, spacing, alignment, sizing, color adjustments or similar refinements may be completed without automatically being treated as a complete revision round.
Revision requests cannot continue indefinitely. Repeated changes of direction, redesigning previously approved areas, entirely new concepts or requests outside the agreed project scope may require additional development fees.
We do not intend to count every tiny adjustment as a revision. The limit exists to provide clients with sufficient flexibility while preventing an unlimited redesign cycle.
Project Completion, Delivery & Final Handover
A project is considered substantially completed when the agreed website or other project deliverables have been completed and made available to the client for final review.
WebSolutionForge may present the completed project on a development environment, staging website, temporary URL or another environment under our authorized control before final handover.
Final administrator credentials, transferable source files, final migration, account transfer, license transfer and other final handover items may be withheld until all outstanding project payments have been received.
Following full payment, WebSolutionForge will provide or transfer the final access and project materials included within the agreed project scope.
Client Delays & Inactive Projects
Project timelines depend on timely information, approvals, access, materials and feedback from the client.
If WebSolutionForge is waiting for required information or client feedback, the estimated delivery date may be extended.
If the client does not provide necessary communication or project materials for at least 30 consecutive days, WebSolutionForge may place the project on paused or inactive status.
When the client returns, work may resume according to WebSolutionForge's current availability and a revised project delivery schedule may be required.
Cancellation & Refunds
Project work begins only after the required initial 50% payment has been received.
If a client needs to cancel after development has begun, WebSolutionForge will consider the work already completed, development time already used and any costs already incurred.
Where appropriate, an unused portion of the advance payment may be refunded after deducting the reasonable value of work already completed and applicable non-refundable costs.
The entire initial payment will generally not be refundable once meaningful project work has been completed. However, WebSolutionForge intends to handle legitimate cancellation circumstances fairly rather than charge clients for work that was never performed.
Third-party purchases remain subject to the refund policies of their respective providers.
Domain, Hosting & Technical Setup
Where included within the agreed project, WebSolutionForge may handle domain connection, DNS configuration, hosting setup, SSL configuration, WordPress installation, website migration and related technical work.
The client remains responsible for the purchase and renewal costs associated with domains, hosting plans and other external services.
If WebSolutionForge purchases a hosting plan, domain or account-based service on behalf of the client, we will, where reasonably practical, register it using client-controlled information or transfer appropriate ownership and account control to the client following full project payment.
Following transfer, the client is responsible for future renewal fees, account credentials, billing information and continued service.
Three-Month Support & Ongoing Maintenance
Unless different support terms have been agreed for a particular project, WebSolutionForge provides up to three months of limited post-delivery support beginning from the final handover date.
Complimentary support covers reasonable assistance relating to the original website delivered by WebSolutionForge, including genuine defects, minor technical corrections and issues directly connected to the approved project.
The complimentary support period does not normally include new pages, new functionality, major redesigns, extensive content changes, additional integrations or ongoing SEO work.
Problems caused by client modifications, unrelated third-party developers, hosting outages, expired services, cyberattacks or external platform changes may require separate paid work.
Once the complimentary support period ends, ongoing website maintenance and support may be offered as a separate paid service. WebSolutionForge may contact the client regarding available maintenance options.
Responsive Development, SEO & Performance
WebSolutionForge aims to develop websites using modern, responsive and performance-conscious web development practices.
Websites are designed to adapt across common desktop, tablet and mobile screen sizes. Exact presentation may vary between browsers, operating systems, devices and future software versions.
Standard development may include normal on-page and technical SEO practices such as logical heading structure, crawlable content, search-friendly page organization, basic metadata configuration where suitable information has been provided, responsive layouts, image optimization and performance-conscious implementation.
Basic website SEO does not guarantee search rankings, traffic, leads, conversions or sales.
Clients requiring dedicated local SEO, local citation building or more specialized search optimization may be referred to our recommended SEO service provider, Local Citation Expert .
SEO results depend on competition, content quality, website authority, search-engine algorithms and many other factors outside WebSolutionForge's control.
Third-Party Platforms & External Services
Websites may depend on third-party platforms and services including WordPress, Elementor, WooCommerce, Shopify, Wix, hosting companies, plugins, themes, payment gateways, APIs, analytics services, email platforms and other external technology.
WebSolutionForge does not control these providers and cannot guarantee their continued availability, compatibility, pricing, security, future updates or functionality.
Future outages, discontinued services, pricing changes or compatibility problems caused by an external provider are not automatically considered defects in the original work delivered by WebSolutionForge.
Ownership & Intellectual Property
Clients retain ownership of logos, trademarks, photographs, written content, business information and other intellectual property supplied by them.
Unless otherwise agreed, rights to custom project deliverables created specifically for the client transfer after all amounts due for the project have been paid.
Third-party themes, plugins, fonts, stock assets, frameworks and software remain subject to their respective licenses and provider terms.
WebSolutionForge retains ownership of its pre-existing tools, reusable components, workflows, development methods, internal processes and general technical knowledge.
Portfolio Use & WebSolutionForge Credit
Unless confidentiality has been expressly agreed in writing, WebSolutionForge may display completed client projects within our portfolio, case studies, project examples and promotional materials.
This may include publicly available screenshots, website links, device mockups, project descriptions and other visual representations of completed work.
Websites designed or developed by WebSolutionForge may contain a small and unobtrusive footer credit such as “Designed by WebSolutionForge” or “Website by WebSolutionForge,” which may link to our website.
This credit forms part of our normal project delivery unless a different arrangement has been expressly agreed.
Outstanding Payments & Project Suspension
WebSolutionForge retains control of unfinished project deliverables and may withhold final handover until all outstanding project fees have been paid.
If the final project balance is not paid within the agreed payment period, WebSolutionForge may pause further work and withhold final administrator access, source files, migration, account transfers, license transfers or other remaining handover items.
Where a website remains hosted, staged or otherwise under WebSolutionForge's authorized control and ownership has not yet been transferred, WebSolutionForge may temporarily suspend publication or access until the outstanding payment issue has been resolved.
WebSolutionForge will not intentionally retain hidden or unauthorized access to a client's website following full payment and final handover.
The final project balance must be cleared before complete transfer of credentials, files and agreed project ownership items.
Liability, Acceptable Use & General Terms
Professional Services
WebSolutionForge will make reasonable efforts to perform services professionally and according to the approved project requirements.
Limitation of Liability
To the maximum extent permitted by applicable law, WebSolutionForge will not be responsible for indirect, incidental, consequential or business losses resulting from the use or inability to use a website, hosting provider, plugin, API, payment gateway, integration or other external technology.
Clients should maintain suitable backups, secure account credentials and appropriate business continuity procedures following final handover.
Unlawful or Prohibited Projects
WebSolutionForge may refuse, suspend or discontinue work that is reasonably believed to involve unlawful activity, fraud, malicious software, unauthorized access, intellectual-property infringement or other activities that violate applicable laws or third-party rights.
Changes to These Terms
WebSolutionForge may update these Terms when reasonably necessary to reflect changes in our services, technology, business practices or applicable requirements.
The current version will be published on the WebSolutionForge website together with its most recent revision date.
Governing Terms
These Terms are intended to be interpreted in accordance with the laws and legal requirements applicable to WebSolutionForge and the relevant transaction unless a different governing arrangement has been expressly agreed in writing.
If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
